Export Policy & Export Restrictions

Government Export Restriction — This item may be regulated for export by the U.S. Department of State or the U.S. Department of Commerce. 

The U.S. Department of State’s Directorate of Defense Trade Controls (DDTC), the U.S. Department of Commerce’s Bureau of Industry and Security (BIS), and the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) administer export control regulations that may affect purchases from AE Tactical (“we,” “our,” or the “Company”). We ask that you (“the Customer”) review and familiarize yourself with the following information regarding applicable export regulations.

General Prohibition

The sale, transfer, transportation, or shipment outside of the United States of any product that is prohibited or restricted for export—without complying with U.S. export control laws and regulations, including required licensing, documentation, or authorization—is strictly prohibited and may result in civil penalties and/or constitute a federal crime. AE Tactical will not engage in any transaction that requires the illegal export or re-export of products and will not assist—directly or indirectly—with any such export. When required, an accurate Automated Export System (AES) filing must be made, whether or not an export license is required.

Orders Intended for Export

If you intend to purchase an item for ultimate shipment or use outside of the United States, please indicate this at the time of your order. Depending on order value, specific items, end user, country of ultimate destination, and end use, AE Tactical may be required to apply for an export license with the appropriate U.S. government agency. Several items may require an export license, including but not limited to:

  • Generation 2, 3, or 4 Night Vision Devices and Accessories
  • Thermal Imaging Equipment
  • Optical Sighting Equipment and Tactical Lights (hand-held and weapon-mountable), accessories, and mounts
  • Tactical gear and weapon accessories
  • Knives
  • Military apparel including body armor, helmets and helmet accessories, and ballistic shields
  • Certain laboratory and electronic equipment

International Traffic in Arms Regulations (ITAR)

Some items sold by AE Tactical are subject to the International Traffic in Arms Regulations (ITAR). Export is strictly prohibited without authorization or an export license issued by the U.S. Department of State’s DDTC. By proceeding with a transaction to purchase any ITAR-restricted item(s), the Customer certifies that:

  • (i) The purchase does not require AE Tactical to export such items unless AE Tactical is aware of the export and has obtained the appropriate U.S. Government authorization;
  • (ii) The Customer will not export such items after receipt without the appropriate U.S. Government authorization;
  • (iii) The Customer will not export, transfer, sell, or furnish the item to any foreign person (as defined in ITAR §120.16), whether abroad or in the U.S., including any foreign embassy, without authorization;
  • (iv) The Customer understands the definition of “foreign person” under ITAR §120.16 and “U.S. person” under ITAR §120.15;
  • (v) The Customer is a U.S. person as defined by ITAR §120.15, or will otherwise comply with all ITAR requirements.

Export Administration Regulations (EAR)

Some items are subject to the Export Administration Regulations (EAR) administered by BIS and may require licensing or be otherwise restricted. By proceeding with a transaction to purchase any EAR-restricted item(s), the Customer certifies that the purchase does not require AE Tactical to export such items unless AE Tactical is aware of the export and has obtained the appropriate U.S. Government authorization, and that the Customer will not export such items after receipt without required authorization.

Important Export Restrictions Warning

  1. Export of certain products is strictly prohibited without a valid export license issued by the U.S. Department of State under ITAR (22 C.F.R. 120–130) or by the U.S. Department of Commerce under EAR (15 C.F.R. 730–774).
  2. U.S. law prohibits the sale, transfer, or export of items to certain restricted parties, destinations, and embargoed countries, as identified on lists maintained by the U.S. Department of State, U.S. Department of Commerce, and U.S. Department of the Treasury. It is the Customer’s responsibility to review these lists and comply with all restrictions. By proceeding with any transaction, the Customer certifies that they will not engage in any unauthorized transaction involving the export of AE Tactical products to any restricted party or destination.

Customer Compliance Certification

By completing a purchase from AE Tactical, the Customer certifies that they will comply with all requirements imposed by applicable laws, regulations, and administrative policies.

AE Tactical reserves the right to inquire into the end user, end use, and country of ultimate destination for any product ordered on this website and to cancel any order that appears non-compliant with U.S. export laws.
